GENERAL TERMS AND CONDITIONS
GENERAL INFORMATION
All information on models, weights and dimensions is approximate and not binding. We reserve the right to make design changes and improvements without prior notice. Machines and parts will only be taken back by prior written agreement and must be in perfect condition.
- The credit is 15% less than the original purchase price.
- The return is at the expense of the sender (customer).
CONCLUSION OF THE CONTRACT
The contract shall only be concluded with our order confirmation.
PRICES AND TERMS OF PAYMENT
Deductions for cash payments are not permissible as long as there are outstanding debts from other invoices. Discount charges, collection charges and all other costs shall be borne by the customer. Unless otherwise stated, prices are ex works without packaging. The purchaser must make payment in accordance with the payment terms stipulated; unless otherwise stipulated, payment must be made within 30 days of the invoice being issued without any deductions. The purchaser shall not be entitled to withhold payment due to the exercise of warranty rights or other counterclaims not recognised by us.
The supplier shall retain ownership of the delivery item until all claims of the supplier against the purchaser arising from the business relationship, including contracts to be concluded in the future, have been settled. This shall also apply when an individual claim or all claims of the supplier have been included in a current invoice and the balance has been extended and acknowledged. If the client breaches the contract, in particular in the case of delayed payment, the supplier shall be entitled, upon reminder, to take back the delivery item, and the client shall be obliged to return it.
SHIPMENT
Any transport damage shall be ascertained in the presence of witnesses (forwarding agent) or experts. The forwarder shall not be liable for transport damage in the event of loading and transport defects that are not immediately reported. Unless otherwise stated in the order confirmation, delivery is "ex works". For our part, delivery shall be deemed to have been made when the goods are handed over to the carrier or forwarding agent. Loading and dispatch shall always take place at the purchaser's risk, even in the case of delivery "free to the addressee" or "free to destination", "free to freight until..." or similar. Accessories without an indication of the freight rate are understood to be "ex works", unless they are delivered together with the machine when the latter is purchased.
DELIVERY PERIOD AND DELAY
The delivery period begins on the day of the final order confirmation, but not before the details of the order to be executed have been fully clarified. We accept no liability for delayed or non-executed deliveries and services by our subcontractors.
WARRANTY
The manufacturer guarantees its products for a period of 12 months from the date of invoice, with the exception of products subject to wear and tear. During the warranty period, the manufacturer undertakes to replace free of charge those parts that its technical department recognises as being under warranty. Labour and transport costs are excluded. This guarantee does not cover tools:
- to which modifications have been made,
- which have been used in unscheduled work,
- which continue to be used after the occurrence of a defect.
The manufacturer shall not be liable for indirect costs in the case of tools under guarantee, such as loss of earnings, consequential damage, etc. For accounting reasons, all spare parts are charged at the time of dispatch, including warranty parts. A credit note is issued upon acceptance of a warranty claim. The client must send the defective parts back to the factory at his own expense.
